By purchasing a ticket or making a booking for a Club 55 Travel Club Day
Tour, you acknowledge and agree that:
A binding contract is formed between You (the Passenger/Ticket Holder)
and TheCoachCompany Pty Ltd trading as Club55 upon confirmation of your
booking.
Booking confirmation and electronic tickets (e-tickets) will be issued
to you via email.
2 Bookings, Amendments, and Seat
Allocations
Ticket Inclusions: Tour fees
cover seat transport, listed itineraries, hosted experiences, and
specifically stated entry tickets, meals, or tastings as outlined in the
official tour itinerary. Unstated personal expenses, additional food,
beverages, and personal purchases are excluded.
Accuracy of Details: You must
ensure all passenger details (names, contact numbers, pickup points, and
dietary requirements) are accurate at the time of booking. Any errors
must be reported within twenty-four (24) hours of booking
confirmation.
Ticket Transfers &
Amendments:
Tickets are transferable to another person provided you notify
Club 55 at least twenty-four (24) hours prior to departure.
Requests to transfer a booking to an alternative tour date are
subject to availability and may incur an administrative fee.
Vehicles and Seating:
Seat allocations are managed at the discretion of Club 55 unless
specific seating mobility arrangements have been requested and
confirmed in writing prior to travel.
Photos of tour vehicles are illustrative only. Vehicle makes,
models, and liveries may vary.
3 Fares, Payments, and
Tickets
Payment Timing: Full payment is
required at the time of booking to secure your ticket(s), unless a
deposit arrangement has been explicitly approved in writing for advance
group reservations.
Payment Methods: Payments can be
made via credit card, debit card, or electronic bank transfer using the
secure links provided on your invoice/quote.
Card and Admin Processing Fees:
Merchant payment processing fees may apply and are non-refundable in the
event of a passenger-initiated cancellation.
4 Tour Execution, Itineraries,
and Delays
Itinerary Variations: Club 55
reserves the right to substitute vehicles, alter travel routes, modify
visited venues, or adapt itineraries due to weather conditions, road
closures, venue unavailability, or operational requirements.
Timings: All departure, arrival,
and attraction times are estimates. Travel can be impacted by traffic,
roadworks, or unforeseen delays. Club 55 is not liable for indirect
losses resulting from travel disruptions.
Unclaimed Belongings: Passengers
are responsible for their personal property. Any items left on board
will be held in lost property for up to ninety (90) days. Freight
charges to return items are borne by the passenger.
5 Passenger Obligations and Code
of Conduct
Punctuality: Passengers must
arrive at their designated pickup location at least 15 minutes prior to
the scheduled departure time.
No-Show Policy: Drivers cannot
hold the tour coach for late-arriving passengers beyond the scheduled
departure time. If you fail to board on time, your ticket is deemed a
"No-Show" and 100% of the fare is forfeited.
Onboard Behavior: Club 55
reserves the right to refuse service or remove any passenger from a tour
without a refund if they:
Exhibit abusive, offensive, aggressive, or unlawful behavior.
Appear excessively intoxicated or under the influence of illegal
substances.
Smoke or vape on board the vehicle or inside restricted venue
premises.
Fail to adhere to minimum dress, safety, or footwear
standards.
Food and Drinks: Only bottled
water is permitted for consumption on board the coach, unless otherwise
permitted by the tour leader.
Medical & Special Assistance:
Passengers requiring assistance animals, mobility devices, or specific
physical accessibility accommodations must disclose these details at the
time of booking. Assistance animals must remain appropriately restrained
and managed throughout the journey.
6 Health, Dietary Requirements,
and Alcohol Safety
Dietary Needs: Passengers must
disclose dietary requirements and food allergies at the time of booking.
While Club 55 communicates these needs to partner venues, passengers
accept personal responsibility for verifying ingredients on site.
Responsible Service of Alcohol:
Where a tour includes wine, beer, or spirits tasting, all alcohol
consumption is undertaken at the passenger’s own risk. Partner
venues reserve the right to refuse service to intoxicated guests under
Responsible Service of Alcohol (RSA) laws.
7 Cancellations and Compensation

8 Force Majeure
Club 55 is excused from performance obligations and holds no financial
liability for delays, alterations, or tour cancellations caused directly
or indirectly by a Force Majeure Event (including acts of God, extreme
weather, bushfires, floods, road closures, pandemics, civil unrest, or
government restrictions).
9 Liability, Risk, and
Indemnity
Limitation of Liability: To the maximum extent
permitted by Australian Consumer Law (ACL), Club 55’s total
aggregate liability for any direct loss or injury arising from a tour is
strictly limited to the total ticket price paid by the passenger.
Personal Belongings & Injury:
Passengers travel at their own risk. Passengers are strongly encouraged
to carry personal travel insurance to cover medical emergencies, lost
baggage, and unexpected trip cancellations.
Indemnity: You agree to indemnify
Club 55 against any third-party claims, property damage, or losses
caused directly by your intentional misconduct, negligence, or breach of
these Terms.
10 Non-Disparagement
Passengers agree not to publish, post, or distribute false, misleading,
or malicious representations intended to cause commercial damage to the
reputation of Club 55 or TheCoachCompany Pty Ltd. This clause does not
restrict your statutory rights to lodge genuine feedback, regulatory
queries, or consumer protection claims.
11 Complaints and Feedback
Procedure
Submission Window: Feedback or
compensation claims regarding a tour experience must be submitted in
writing to customerservice@club55.com.au
within thirty (30) days of tour completion.
Evidence Requirements: Claims
must include supporting details (photographs, receipts, or factual
written accounts).
Resolution Timeline: Club 55 will
review claims in accordance with procedural fairness and aims to deliver
a formal determination within 14 Business Days.
Chargeback Restriction:
Passengers agree to exhaust this formal dispute process prior to
initiating chargeback proceedings with financial institutions.
12 General Provisions
Governing Law: These Terms and
Conditions are governed by the laws of the State of Western Australia
(WA) and the Commonwealth of Australia.
Severability: If any provision of
these Terms is deemed invalid or unenforceable by a court of law, that
specific provision shall be severed without affecting the remaining
legal enforceability of the contract.
Privacy: Passenger personal data
is handled in accordance with the Privacy Act 1988 (Cth) and Club
55’s published Privacy Policy.
